We have been getting reports in early March that ATF eForm users are experiencing issues uploading .EFT Files. The error affects individual applicants and gun trust applicants.
When you upload your .EFT File, your .EFT File will upload successfully and you can continue applying for your tax stamp application. However, if you return to Screen 4 - Responsible Persons page and open up your responsible person specific page, you will receive the below error and the .EFT File box will be blank and doesn't show the uploaded .EFT File.
ERROR - Message: There was an error. Please try again. If the problem persists, please contact your system administrator.
There is no fix to issue as of yet. We have received reports that this error doesn't affect submission and ultimately approval of the application. The ATF doesn't have a fix implementated as of this posting.

If you use eForms to file the ATF Form 2 pursuant to 27 CFR 479.103, you will be permitted to submit the ATF Form 2 by the close of the next business day after the eForms system is back online. This delay in submitting your required ATF Form 2 is only applicable for this outage that began at 2358 on February 27, 2024. You should check periodically if eForms is back online.
While you may submit a paper application, you are encouraged to wait until the eForms system is back online.

The card information is either typed in or hand written on page 3 of the ATF Copy (shown below). But there is no section for the three-digit code (security code) that is located on the back or front of the credit card. That is normal. The ATF doesn't require this information when your credit card payment is processed.

Before you start the walk-through be sure to download a copy of each form from the links above. We have also included an example filled out form that you can reference along the way, as well. The ATF Form 5630.7 contain fillable fields for Adobe Acrobat. Which makes it very easy to go through the form.
Start of the ATF Form 5630.7 - Section I - Taxpayer Identifying Information
1. Type of Application. You choose why you are using this form. The options are self explanatory, but you will need to circle one reason.
2. Tax Year. This is the tax year that you are filing for. New tax years start on July 1st and end June 30th of each year. If you are applying in the middle of the tax year, you will still indicate the July to June current tax year. Most commonly parties will apply for a new SOT license to begin in a future tax year if they are in the middle or end of a current tax year. This is due to the taxes due. They aren't prorated if you are applying for a current tax year in the month of February. Amendments won't require for the tax to be repaid. *Make sure that you put one tax year in question 2, we will not process if tax year is left blank.
3. Employer Identification Number. This is your EIN number that is issued by the IRS. You must have an FEIN whether you are an individual owner, partnership, corporation, or agency of the government. If you do not have an FEIN, you may apply online and revisit this form.
4. Federal Firearms License: (FFL). This is your current full FFL license as shown on your FFL. If you are amending your SOT to a new location. You would need to first amend your FFL. This can be done using the ATF 5300.38 - Application for an Amended Federal Firearms License.
5. Name or Corporation. This is the individuals name or corporation name if a corporation/business.
6. Trade Name. This is your trade name if it differs from your name that you indicated in box 5. This can be left blank if the trade name is the same as your name in box 5.
7 and 8. Physical Address of Principal Place of Business. This is physical address of your FFL / SOT or the physical address of your new location. If you are amending your SOT license to a new location, you will indicate your current physical address. The new location address will be entered in box 18 (b) of this form.
9 and 10. Mailing Address. This is your mailing address. This might be different than the address you entered in box 7 and 8.
11. Phone Number. This is your current business or SOT contact phone number.
12. Email Address. This is your current business or SOT contact email address.

13a - 13e. Tax Computation. In this section you find the class of license that you are applying for, adding or amending (13a), indicate the number of locations that you will be using the SOT license for (13c) and multiple the location amount by (13)c to get your Tax Due on (13e). For example, if you are first time Class 3 - Dealer in firearms with one location, you would multiple one location (13d) by $500 (13c). The total tax due in this example would be $500. If your gross receipts are less than $500,000 for your most recent tax year (not just receipts relating to the activity subject to special occupational tax), you may qualify for the reduced rate indicated with an asterisk. If your business is beginning an activity subject to special tax for the first time, you may qualify for a reduced rate in your initial tax year if gross receipts for the business (or the entire control group, if a member of a control group) were under $500,000 the previous year. If you are eligible for the reduced rate, check item 15 in Section III and compute your tax using the reduced rate in Section II.

14 Total Tax Due. This is the sum of table (13e) Tax Due.

15. Ownership Information. This is where you will indicate ownership information. You will only check one box.
16. Ownership Responsibility. This is the owners full name, address and position. If you need additional space, you can use a separate sheet of paper.
17. Gross Receipts less than $500,000. If your gross receipts are less than $500,000 for your most recent tax year (not just receipts relating to the activity subject to special occupational tax) you would select this check box. If you need additional space, you can use a separate sheet of paper.
18. Existing Business With Change In. If you are making a changes when you are using the ATF Form 5630.7, for a renewal, amendment or new location or class, you can indicate that information in this section. For new SOT payer, this section would be left blank.
19. Discontinued Business and 20. Date. If you are amending your SOT to indicate that the business is discontinued, you would check that box here and the date that the business is discontinued.

When applying for a tax stamp application with a gun trust, is quite common to have co-trustees who reside in different cities, counties, states, etc. That however, can complicate which CLEO is named within the application.
The settlor, grantor, or head of the gun trust will name their respective CLEO within the actual application, e.g., ATF Form 1, ATF Form 4, ATF Form 5. Their CLEO would also be named in their ATF 5320.23. The co-trustees within the gun trust would name their respective CLEO's on the ATF 5320.23. If the co-trustee's CLEO is different than the settlor's, the co-trustee would need to send the CLEO copies of the tax stamp application and the CLEO copy of their ATF 5320.23 to their named CLEO.
]]>Once your gun trust is notarized, signed and dated it is executed. You will keep your original gun trust paperwork. You would only need to send a copy of your gun trust to the ATF when you are applying for a tax stamp. You won't need to send your gun trust to the ATF without a tax stamp application to be "pre-approved."
Depending on the county and state that you reside in, you may want to have your gun trust recorded with your local county clerk's office too. This is a common practice because the county clerk's office is responsible for maintaining public records, which includes gun trusts and trusts.

Apply OnlineYou can apply to the VAF online via eVAF. During the application process, you will receive an email with an encrypted link and pin to access your application. You must log in to the application at least every 90 days for it to remain active.
Screen 1 VAF Application. Scroll down to the bottom of the screen. You will need to enter in your email address on the right side of the "Applying for the Voluntary Appeal File (VAF)" section of the website. Note: You will be receiving an email with a login link and pin to the email address that you enter on this page. So make sure your email address is correctly entered here.
Screen 2 Email Submission Confirmation. Check your email for your application link and password. The email will be coming from edo@services.fbi.gov with subject line Identity History Summary/Firearm-Related Challenge Request. This email will contain the link to complete your application and your application PIN number.
Screen 3 Logging In to the VAF Application. You will click the link that is located in the email that was sent to you. Once you click the link, you will need to read and acknowledge the popup message before continuing to enter your PIN number. You will lastly need to enter in your PIN that was also located in the email to continue and login.
Screen 4 Challenge Details. You have three options after clicking login. For a UPIN VAF application, you will be selecting the second radio button: Apply for Voluntary Appeal File (VAF). After selecting the second radio button, you will need to read and accept the Privacy Act Statement to continue.
Screen 5 Completing the eVAF Form. You will need to complete each box that has a red box around it. The boxes are self explanatory but also have a detailed explanation below in the paper application section. For the Supporting Documentation section you can upload any documentation that is relevant to your application. Which may consist of the below:
Once you have completed this form, you can click submit. You would need to verify your mailing address, date of birth and social security number. After you have verified that information you can click yes. Another confirmation will popup to verify that you want to apply for the Voluntary Appeal File (VAF) Application. Click yes to continue.
Screen 6 Submission Confirmation. You will need to send your physical fingerprint card along with a copy of the confirmation email that was sent to your email to the address below. You can download your original request application for your records too.

Post Application. Your application is submitted after you hit submit. The fingerprint card can must be physically mailed into the FBI with your confirmation email (see above step).
You can also use the application link and pin to check the status of your application and cancel your application if you need to cancel your application.
You can apply using the paper application. The paper application would be completed and mailed to the FBI. The .PDF can be downloaded and completed using a .PDF editor. But note that the Applicant's statement must be physically signed and dated.
Last Name, First Name, Middle Name, Suffix (Cadence). This your last name, first name, middle name and cadence. Cadence includes Jr, Sr, II (second), III (third), etc.
Date of Birth - Month, Day, Year. This is our birth date formatted numerically, e.g. 08 02 2023.
Place of Birth (State). This is your birth state. Don't include your birth city.
State of Residence. This is the state that you reside in.
Country of Citizenship. This is your current citizenship.
Social Security Number. This is your social security number.
Miscellaneous Number. This other identification numbers that you have, for example: Driver's License, Military ID, etc.
Alien or Admissions Number (*mandatory if Country of Citizenship is other than US). This is your AR, USCIS, or I-94A Number. If you are an alien, record your U.S.-Issued Alien or Admission Number you will enter that here.
Race. This is your race.
Ethnicity. This is your ethnicity.
Sex. This is your sex.
Applicant's Address (for receiving correspondence). This is your best contact mailing address, phone number, and email address. This may differ from your drivers license, etc.
Applicant's Statement. You will need so sign and date this section and is required. If the required signature is absent, the application cannot be processed and will be returned to the applicant.
"I give the information on this Voluntary Appeal File (VAF) application, and any supporting documentation provided therewith, voluntarily with the understanding that if my application is approved, I will be entered into the VAF maintained by the National Instant Criminal Background Check System Section of the FBI's Criminal Justice Information Services (CJIS) Division. I further voluntarily consent that the FBI may retain my application, any supporting documentation, and any research information relevant to the approval of my VAF application. I further understand if, at any time, I wish to be removed from the VAF, I can make such a request in writing to the FBI's CJIS Division, at the address below. ]]>The term ORI that is located on the FBI/ATF FD-258 fingerprint cards is short for originating agency identification. The ORI number is a nine-character identifier assigned to an agency. The ORI helps the FBI and the ATF designate the originating agency for the fingerprint cards that are being submitted. For applicants who are submitting .EFT Files for the ATF NFA application the ORI number that is most commonly used is: ATFSIMPLE. However, other ORI's can be used. Other common ORI's that are used are WVATF0800, WVATF0900, PRINTSCAN, etc.
]]>If you are an alien, you will need to enter in your I-94 Number, USCIS Number or AR Number. You can add your USCIS Number or "A" Number into your ATF eForm application on the Applicant page under the Maker's Questions. Box 13 is where you enter in your USCIS Number. The box will not directly accept your number. That field requires you to enter in text before you enter your number.

On January 4, 2016, the Attorney General signed ATF Final Rule 41F, Machineguns, Destructive Devices and Certain Other Firearms; Background Checks for Responsible Persons of a Trust or Legal Entity With Respect To Making or Transferring a Firearm, amending the regulations regarding the making or transferring of a firearm under the National Firearms Act (NFA). The goal of the final rule is to ensure that the identification and background check requirements apply equally to individuals, trusts, and legal entities who apply to make or receive NFA firearms.

With the Final Rule 41F in effect, all responsible persons within the gun trust at the time of application will need to submit fingerprint cards to the ATF. You can create your own fingerprint cards that can be used for ATF paper applications and ATF eForm applications. You can find them here. In the case of an unlicensed entity, including any trust, partnership, association, company (including any Limited Liability Company (LLC)), or corporation, any individual who possesses, directly or indirectly, the power or authority to direct the management and polices of the trust or entity to receive, possess, ship, transport, deliver, transfer, or otherwise dispose of a firearm for, or on behalf of, the trust or legal entity.
In the case of a TRUST, those persons with the power or authority to direct the management and policies of the trust include any person who has the capability to exercise such power and possesses, directly or indirectly, the power or authority under any trust instrument, or under State law, to receive, possess, ship, transport, deliver, transfer, or otherwise dispose of a firearm for, or on behalf of, the trust.
