What Happens to Suppressors Already Registered to a Gun Trust After the Silencer Shop Ruling?
Suppressors/silencers that were registered with the ATF to a gun trust before the Silencer Shop Foundation v. ATF ruling do not automatically become unregistered or leave the gun trust. The silencers will still be owned by the gun trust and the existing tax stamp paperwork will still be valid. Meaning there will be no issues with already registered NFA firearms within your gun trust.
The ruling only changes new transactions and how they are treated after the ruling. It doesn't cancel out any previously approved tax stamps, change the gun trust, or change any already approved tax stamps. Nothing changes there. What could change in the future, is how new suppressors that were processed on an ATF 4473 only be transferred into your gun trust. We will provide updates, as the ATF guidance becomes available.
