Do I Fill Out the Number of Responsible Persons and Name(s) If Filing as an Individual?

When applying as an individual using the ATF 5320.1 Form 1, ATF 5320. 4 Form 4 or the ATF 5320.5 you are required to fill out the "Number of Responsible Persons" and the Name(s) of the responsible persons box below.  This is reserved for applicants who are applying using a gun trust or a legal entity. The definition can be found within the ATF paperwork, but we have include it below for reference:

Completion of Form:
If the transferee is an individual, the entire Form 4 shall be completed except for items 18 and 19.

The "Responsible Persons" and Name(s) sections that can be omitted if you are applying as individual are listed below:

  • ATF 5320.1 Application to Make and Register a Firearm:
    • Box 15 and Box 16 
  • ATF 5320.4 Application for Tax Paid Transfer and Registration of Firearm:
    • Box 18 and Box 19
  • ATF 5320.5 Application for Tax Exempt Transfer and Registration of Firearm:
    • Box 18 and Box 19
