ATF FINAL RULE 2021R-08F Published to Federal Register

The ATF FINAL RULE 2021R-08F was published to the federal register today, 1/31/2023.

This means that a gun trust can't apply for the brace eligible stamp, unless the firearm was assigned, transferred and dated before 1/31/2023. The ATF will want evidentiary proof showing that the firearm was added to the gun trust before 1/31/2023. This is typically done by having an assignment sheet that is notarized, signed and dated included with the application.

If you are still looking to have the firearm ultimately go into your gun trust, you can apply for the ATF Final Rule 2021R-08F tax stamp as an individual.  Once approved, you can then use the ATF Form 4 to transfer the firearm into your gun trust.
