Does Question 13. "Transferee Necessity Statement" on the ATF Form 4 Need to Be Filled Out for a Silencer?

When you are applying for a tax stamp using the ATF Form 4 paperwork, the ATF Form 4 paperwork states the following pertaining to Question 13: Transferee Necessity Statement:

  1. Transferee Necessity Statement. Item 13 must be completed by the transferee if:

    1. (1)  the firearm to be transferred is a machine gun, short-barreled rifle, short-barreled shotgun, or destructive device;

    2. (2)  the transferor is licensed under the GCA to deal in such device or fire arm; and

    3. (3)  the transferee is not licensed under the GCA to deal in such device or firearm.

What does this mean for an individual, a gun trust or a legal entity that is applying for a silencer that isn't listed and named in 5.1?  The ATF doesn't require box 13 to be filled out if you are applying for a tax stamp for a ATF Form 4 silencer.  If you are applying for a tax stamp for a ATF Form 4 silencer you still can answer this question, but isn't required by the ATF. The most common answered if answered are "All Lawful Purposes" or "Investment and All Lawful Purposes".
