Individual to Individual/Gun Trust - Out of State NFA Firearm Transfer

NFA Firearms can't be transferred privately from state to state.  A SOT dealer has to be involved with that transfer whether the transfer is individual to individual or individual to a gun trust, gun trust to gun trust, etc.  There are essentially two ways to make the out of state transfer.  The distance between the two the states might determine the best course of action for your transfer. 

Out of State NFA Firearm Transfer for Nearby States:

The current owner, a.k.a. transferor can transport the NFA firearm to the SOT dealer in the state where the ultimate transferee resides.  The transferor will need to transfer the NFA firearm to that SOT dealer using the ATF 5320.4 Form 4 paperwork.  From there that SOT dealer would then use the ATF 5320.4 Form 4 to transfer the NFA firearm to the ultimate transferee. Both ATF 5320.4 Form 4 transfers will incur the $200 National Firearms Act tax stamp fee.  This means that the total transfer cost would be $400.  Note:  Out of state permanent address changes will require the use of the ATF 5320.20 Application to Transport NFA Firearms before the NFA firearm is transferred to the out of state SOT dealer.

    • 2 - ATF 5320.4 Form 4 Transfers - Transferor to SOT dealer - SOT dealer to ultimate Transferee
    • ATF 5320.20 Form 20 to permanently transfer the NFA firearm out of state. 
  • Tax Stamp Cost: $400

    Out of State NFA Firearm Transfer for "Faraway" States:

    The current owner, a.k.a. transferor will need to transfer the NFA firearm to an SOT dealer in their state using the ATF 5320.4 Form 4 paperwork.  From there that SOT dealer would then use the ATF 5320.3 Form 3 to transfer the NFA firearm to the SOT dealer in the ultimate transferee's state.  Lastly, that SOT dealer would then use the ATF 5320.4 Form 4 to transfer the NFA firearm to the ultimate transferee.  Both ATF 5320.4 Form 4 transfer will incur the $200 National Firearms Act tax stamp fee.  This means that the total transfer cost would be $400.
