Can I Use My Silencer If I Lost My Tax Stamp?

Your silencer ownership doesn’t change if you lose your original tax stamp from the ATF.  When you use your silencer or NFA Firearms you should carry a copy of your approved stamp with you and a copy of your notarized gun trust (if applicable).  The ATF notes on the ATF Form 1, ATF Form 4 and the ATF Form 5 that, “Proof of Registration: A person possessing a firearm registered as required by the NFA shall retain proof of registration which shall be made available to any ATF officer upon request.”  To help alleviate any confusion on the ownership of you may not want to use your silencer or NFA Firearm until you can get a certified copy of your tax stamp from the ATF.  If you need to request a certified copy of your gun trust, you can use our generator to help create the letter that you will send to the ATF.  The time it takes to receive your certified copy of your tax stamp can take a few weeks to a month or more depending on the ATF.
